Privacy Policy

The YCS Group website (the “Site”), the iGiftback® Mobile Application (patent pending) (the “App”), and other mobile applications developed by YCS® Group, LLC (collectively with the App, the “YCS Mobile Applications”) (the Site together with the YCS Mobile Applications and any other YCS website, collectively, the “Services”), offer merchants, consumers, not-for-profit and for-profit organizations, and public entities access to a variety of digital consumer benefits. YCS Group, LLC (sometimes hereinafter referred to as “YCS”, “we”, “our” or “us”) owns and operates the Services. When you use, register with, or order or buy products and services using the Services, you provide YCS with personally identifiable information relating to you.

YCS takes your privacy seriously. This Privacy Policy describes how YCS collects, uses, shares, stores and protects your information. This Privacy Policy applies to everyone who uses the Services that link to or reference to this Privacy Policy. This Privacy Policy also applies when you receive electronic communications from YCS. YCS reserves the right to modify this Privacy Policy at any time in its discretion.

Privacy Policy Updates

We reserve the right, at our discretion, to update, change, modify, add to, or remove provisions from, this Privacy Policy at any time by posting a revised version of this Privacy Policy. You should review our Privacy Policy carefully before registering on the Services, placing any order, conveying any information to YCS, or offering YCS-created applications under your brand name. Your continued use of the Services, or any YCS product or service following the posting of any changes to this Privacy Policy means that you accept such changes.

Information We Collect

We receive and may store any information you enter on the Services, send to us via email, give to us over the phone, by mail, in person or by other means, or provide through the App or other mobile applications. We collect information from you whenever you place an order, create an account, use the Services, call or email us with an inquiry, or use any other YCS products and services.

The information we collect from you includes such things as:

 your name;

 email address;

 billing, shipping and/or mailing addresses;

 telephone number;

 location information; and

 date of birth

We ask you to provide us with your birthdate, which we use to offer you special birthday deals and discounts and for age verification purposes. (See “We Do Not Solicit or Collect Information from or Concerning Minors,” below.) We may use a third-party vendor to send out birthday deals, discounts and other offers. In that event, we would disclose your name, email address and birthdate to the vendor, and their use of your information would be governed by that vendor’s privacy policy rather than this privacy policy.

When you use the Services, our web servers will automatically recognize and store information regarding your method of accessing the Services, such as your Internet Protocol (IP) address and domain name.

YCS may also collect other information regarding your interaction with the Services, including information about any charitable organization, fundraising group, participating merchant, for-profit or not-for-profit organization, or public entity with which you are affiliated, fundraising results and other data relating to your fundraising activities, your purchase and use of products and services offered through the Services, and information that you otherwise provide to us.

The Services may collect such information as the type of mobile device you use to access the Services and your location to help you find fundraising partners, merchants, discounts and promotions that are closest to you, to offer you special discount offers and opportunities, and to provide you with location-based products and services.

End Users’ Location/GPS Data and Other End User Data

YCS uses Google Analytics to collect and evaluate data on who uses the Services, and the products and services offered via the Services, on what devices and where they come from, how end-users use the Services, how the Services are performing and any issues with their performance, and to help identify ways to improve the Services to make users’ use of the Services more enjoyable and convenient. In order to provide these analytical services, Google may collect personal information related to the user, including geolocation, device used to access the Services, the operating system of that device (OS), network status, API Key, MAC Address, International Mobile Equipment Identity (IMEI), User ID, gender, and age. Google installs a Google Analytics Tracking Code on the Services for the purpose of collecting such data on user activity and sending those data to Google Analytics for evaluation. These tracking devices collect, use, share and store data about the user. Users of the Services are encouraged to visit Google’s website, at www.google.com/policies/privacy/partners, to learn more about how Google Analytics collects and processes user data. Cookies, Web Beacons and Similar Devices

When you use the Services, we may use cookies, web beacons or similar technologies.

“Cookies” are small bits of information that may be placed on a user’s computer by a website or mobile application to store the user’s preferences or to otherwise make it easier for a user to interact with a website or mobile application. “Web beacons” are electronic files that may be used to deliver or identify cookies, to monitor usage of a website or mobile application, and/or to track online activity of end users.

The Services may use cookies, web beacons or similar technologies for various purposes, including without limitation to store certain information on your computer, device or phone, manage your use of our websites and enable your use of the Services, facilitate your logging into and interaction with or use of the Services, help authenticate your usage of the Services, keep records, store your preferences, enhance your experience with the Services, operate and improve the Services, and products and services offered through the Services, and collect device and usage information.

We Do Not Solicit or Collect Information From or Concerning Minors

YCS does not collect the names and information of minors within the organizations we serve or who use the Services. YCS does not knowingly collect or solicit personal information from children under the age of 13 or knowingly permit children under 13 years of age to establish accounts with YCS or purchase goods or services from YCS. If you are under 13 years of age, please do not attempt to send us any information about yourself. In the event that we discover that we have collected personal information from a child under 13 years of age, we will delete that information. If you believe we may have obtained information from or about a child under 13 years of age, please contact YCS at info@ycsGroupllc.com.

If you are less than thirteen (13) years of age and have attempted to use the Services, you must immediately terminate, remove and delete the Services from any device on which you have accessed or installed it and discontinue its use. YCS reserves the right to terminate, immediately and without notice, access to and use of any of the Services by any user that YCS® discovers to be younger than thirteen (13) years of age.

If you are thirteen (13) years of age or older but younger than eighteen (18) years of age (a “Supervised User”), you must review the Terms of Use and the End User Agreement for the Services with your parent or legal guardian to ensure that your parent or legal guardian (1) understands the Terms of Use and End User Agreement and (2) acknowledges and agrees to be bound with you by the Terms of Use and End User Agreement. If a Supervised User’s parent or legal guardian does not acknowledge and agree to be bound by the End User Agreement, the Supervised User must immediately

remove the Services from any device on which the Supervised User previously installed such YCS® Mobile Applications and must discontinue use of the Services.

How Do We Use the Information Collected

YCS uses your information to provide products and services and to serve and provide core business functions, including (among other things):

 facilitating and fulfilling orders and requests for products, services or information;

 tracking, confirming and authenticating orders and redemptions;

 providing customer service and responding to customer inquiries or complaints;

 marketing and advertising products and services;

 establishing and managing your account(s) with YCS;

 conducting research and performing analysis to measure, evaluate, enhance and improve the success of YCS’s products and services;

 evaluating your eligibility for offers, promotions, products and services that may be of interest to you or that may be available to you based on your location;

 analyzing the effectiveness of offers, promotions, products and services of our participating merchants;

 facilitating or administering rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored by YCS or its participating merchants;

 implementing loss and fraud prevention measures;

 performing legal functions;

 operating, evaluating and improving YCS’s business;

 operating, maintaining and improving the Services and our products and services;

 providing you with personalized offers and promotions from participating merchants; and

 making the Services easier to use by reducing the need for you to re-enter information.

YCS uses information we obtain from you to understand visitor traffic patterns through the Services to analyze results of fundraising activities that use YCS products and services, and to identify merchants whose discounts and promotions users of the Services patronize.

If you are a non-profit or charitable organization: In addition to the above, YCS will, at its discretion, maintain information about your charitable organization or fundraising group, fundraising results and other data related to your fundraising activities for use in further promotions, analysis and sales of YCS services to you and to other fundraising groups or organizations.

If you are an end user: YCS will provide information about you to any merchant whose promotions or discounts you acquire using YCS products or services. YCS may provide your email address to participating merchants whom you patronize using discounts or promotions provided via products or services offered through the Services, to facilitate efforts by the participating merchants whom you patronize to send you additional

discounts, offers and promotions in which you may have an interest, and to facilitate authentication of your account with YCS. In addition, our participating merchants receive aggregate data concerning users and usage of the Services, and products and services offered through the Services.

YCS’s Privacy Policy does not apply when you are using third-party applications, or when you are using YCS-created applications distributed by a third-party. Such applications may be governed by their own privacy policies, which you should review and with which you should familiarize yourself.

In addition, YCS will retain your information for as long as your account remains active with YCS and/or for as long as necessary to provide you with products or services and/or to comply with applicable legal obligations and/or to resolve any disputes and/or to enforce our agreements.

How Do We Share the Information Collected

YCS does not sell, rent or trade your personal information to third parties, though it may decide to do so in the future, at which time it will update this privacy policy to describe how it sells, rents, or trades your personal information with third parties.

We may disclose your personal information or information about you to third parties in the following circumstances:

Affiliated Companies. We may disclose your information to affiliates and other entities within our corporate family of businesses. We may share and use your personal information with our other business units and operations and may continue to do so even in the event that, and after, such business units or operations are sold.

Third-Party Service Providers, Vendors and Merchants. We share your information with third parties with whom we contract to: (i) distribute information relating to the Services and products and services offered through the Services; (ii) provide and deliver discounts and promotions described on and/or in connection with the Services; (iii) maintain email alerts lists and fulfill orders and requests submitted via our salespersons and/or the Service; (iv) ship and deliver orders for YCS products, and honor discounts and promotions made available through the Services (including, without limitation, YCS Value Passes); (v) host certain portions or functions of the Services; (vi) provide technical or professional services to us; and/or (vii) conduct research and analysis in order to improve the Services and our products and services. We may disclose your information and information of other YCS customers, in aggregate form, to third parties for purposes of performing benchmarking activities and analyses. We may also disclose your information to third parties in connection with our performance of any services we are required to perform in our agreements with you.

We share your information with our participating merchants and business partners (i) to the extent that we offer products or services jointly with those merchants or business

partners, (ii) to facilitate a direct relationship between you and a participating merchant or business partner, (iii) to facilitate electronic communications in connection with any purchase, offer, promotion or discount, and (iv) to the extent you participate in any offer, promotion, contest, sweepstakes, or other program or activity offered through YCS or the Services. The use by our participating merchants and business partners of information obtained from YCS or through the Services is governed by the participating merchants’ and business partners’ privacy policies and is not subject to the control of YCS.

Credit Card Companies. Credit card transactions are handled by third-party financial institutions and their vendors and contractors. We provide these entities with credit card numbers and other personal information to verify the credit card information provided and to process credit card transactions. Note that, while YCS’s use of this information is governed by this Privacy Policy, the use of your information by these third-party entities will be subject to their own privacy policies.

Third-Party Merchant Payment Processing Companies. Some YCS clients may have and exercise the option to collect payment for discounts and promotions directly from consumers using a PayPal account or other third-party merchant payment processing company. To accomplish transactions using one of these payment methods, you may be asked to provide account, payment and other personal information to the payment processing company. YCS has no role in determining the information that these payment processing companies choose to collect, nor does YCS obtain access to information collected by these companies. In addition, YCS does not share your information with these payment processing companies. The use of your information by these third-party payment processing companies is governed entirely by those companies’ privacy policies and terms of service.

Legal Compliance and Protection of Rights. We may share your personally identifiable information with third parties, including law enforcement agencies or others, when we determine, in our judgment, that it is appropriate or necessary: to comply with legal requirements; to cooperate in a judicial or other legal proceeding; if we believe that you have harmed or interfered with (or may harm or interfere with) YCS, other YCS customers, users or anyone else; to enforce or apply our agreements (including without limitation any End User Agreement), the Services’ policies, terms and conditions, or other contractual commitments; or to assert, defend, or protect our rights or property or the rights, property, health or safety of our customers, vendors, merchants, users or other persons. If we receive legal process calling for the disclosure of any of your personally identifiable information, we will attempt to notify you via the email address you supply during the registration process within a reasonable amount of time before we respond to the request, unless such notification is not permitted.

Business Transfers. We may disclose your information to third parties in connection with a potential or actual transaction or proceeding involving a transfer of some or all of, or any interest in, the businesses or assets of YCS, a YCS affiliate, or the business to which the information pertains. We may transfer any information we have about you in connection with a merger or sale (including a transfer made in connection with

bankruptcy or insolvency proceedings) involving all or part of YCS or a YCS affiliate, or as part of a corporate reorganization, a stock or asset sale, or another change in control of YCS or such affiliate.

How We Safeguard the Information Collected

We use reasonable security measures to protect the confidentiality of personal information in our possession and under our control, and we appropriately limit access to such information, to safeguard your personal information and to minimize the risk of unauthorized access and disclosure. We cannot, however, guarantee that your information will never be disclosed in a manner that is unauthorized.

YCS cannot and does not warrant or ensure the security of any information you transmit or provide to us, and you do so at your own risk. As a global communications network, the Internet is susceptible to threats, viruses and interference from others; YCS cannot promise, and you should not expect, that YCS will be able to protect your personal information at all times and in all circumstances.

Please keep your password confidential. In using the Services, please be careful to protect against unauthorized access to your password and to your computer, phone or device, and be certain to sign off after using a shared computer.

International Information Transfers

If you are located in a country whose laws concerning data collection and use differ from those of the United States, be advised that you are transferring and/or permitting transfer of information, including personal information, to a jurisdiction that does not have the same data protection laws as your jurisdiction, and in doing so, you consent to the transfer of information to the United States and the use and disclosure of information (including personal information) about you as described in this Privacy Policy.

How We Respond to Do Not Track Signals

YCS does not track Services users over time and across third party websites to provide targeted advertising. Accordingly, we do not currently respond or take any action with respect to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about an individual consumer’s online activities over time and across third-party websites or online services.

California Privacy Rights

If you are a California Resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of personal information about you by YCS to third parties for the third parties’ direct marketing purposes. To make such a request,
